Application of these general terms and conditions of sale:
The general terms and conditions presented apply to any purchase made from the company SAS BOTT on its online store via the website domainebott.fr To know the conditions of his order, the customer can click at any time, even before placing an order, on “General Terms and Conditions of Sale”.
Placing an order implies the full and unrestricted acceptance by the customer of the various clauses presented in these GTC. Only a written agreement stipulating special conditions between the two parties can be accepted, without which these conditions as presented are automatically applied in the existing contractual relations between the Customer and the company SAS BOTT.
The offers presented by SAS BOTT are reserved for individual customers and corporate entities such as companies, groups.
The customer declares before validating his order to have accepted these GTC and consequently, to fully adhere to them.
Ordering procedure:
All orders are placed on the website domainebott.fr
The customer creates a basket by choosing the number of products desired. Once their selection is made, the customer validates their basket and method of payment.
After accepting the GTC, orders become final when they are validated by the payment for the products.
The verification service of SAS BOTT is entitled to request proof of identity and address from the customer (K-bis extract, intra-community VAT number for legal entities) to validate the order. In case of refusal by the customer or non-compliance of the documents, SAS BOTT may refuse and cancel the order. On the other hand, if the customer does not want to submit to this check, it may cancel the order.
The verification service is also entitled to cancel certain orders if it deems that the latter present various anomalies and irregularities (doubts about the identity of the clients, usurpation, creation of irregular accounts, etc. …).
An invoice is issued by SAS BOTT and sent by email or by post. An order confirmation is sent by email.
In accordance with the terms of law n°80 336 of May 1, 1980, regarding retention of title, the products remain the property of SAS BOTT until full payment of the invoices.
The customer becomes the owner and responsible for the items upon delivery, with the transfer of possession constituting the transfer of risks.

PRICES:
For France, prices are expressed in Euros (€) and displayed including all taxes (French VAT and any other applicable taxes). For other countries of the European Union, the price varies depending on the country of delivery of the product and takes into account the local VAT of the country of consumption and other taxes (excise duties).
The price indicated on the product sheets is excluding shipping costs. On the same product, the price may vary depending on the quantities chosen. Shipping costs vary depending on the delivery method chosen by the customer.
SAS BOTT reserves the right to modify its selling prices.
Shipping your package
Packages are generally shipped within 3 to 5 days after receipt of payment. They are shipped via national carrier and/or express carrier in packaging suitable for transport.
Any change of delivery address after order validation systematically incurs additional costs which will be passed on to the customer, please contact customer service by email with the new information: bott@domainebott.fr. These additional costs must be paid before delivery.
Shipping costs include handling and packaging fees as well as postage costs. Handling fees are fixed, while transport fees vary depending on the total weight of the package. We recommend that you group all your items into one order. We cannot combine two separate orders and shipping charges apply to each of them.
SAS BOTT reserves the right to stop shipments depending on weather conditions in order to preserve the quality of the wines. However, it is possible to provide you with a transport quotation for suitable shipping, for example: refrigerated transport, regulated temperatures. We will ask you to contact us directly by email to explain your request.
Delivery:
Purchase with NATIONAL DELIVERY: Upon receipt of payment for the order in its entirety, SAS BOTT initiates transport and delivery operations. Delivery of the ordered items is made to the address provided by the customer. The delivery information provided by the customer is binding on him. In case of error or lack of information resulting in a defect or absence of delivery, the company SAS BOTT cannot be held responsible. In case of return for incomplete address, the customer will have the option either to modify his address and have the merchandise resent at his own expense for the new return costs, or to be refunded for the order, deducting the initial shipping costs.
Purchase with COMMUNITY DELIVERY / GRAND EXPORT: Regarding customers wishing to be delivered to a country of the EU or to Export (outside the EU), please contact the office by email bott@domainebott.fr or by phone at +33(0)6 12 73 27 51 for a quotation adapted with the necessary documents for customs and entry into the destination country. Any order with delivery in Europe or outside the EU is processed separately from our internet shop, it is managed by our services directly with the customer.
Transport responsibility / Disputes:
It is the customer’s responsibility to check the contents of the package upon receipt and to make reservations if necessary, as follows:
IN THE PRESENCE OF THE DELIVERY PERSON write on the carrier’s delivery slip the details of the reservations (with number of packages, number of broken, missing and/or damaged bottles). One copy of the delivery slip is given to the delivery person, the other must be kept by the customer. After taking photos of the condition of the cartons/bottles the customer must send within 24 hours following the delivery an email to the service of the company SAS BOTT with attached the delivery slip listing the reservations and the supporting photos – Email to: bott@domainebott.fr
These general terms and conditions of sale are subject to French law. In case of disputes, the customer will contact by email bott@domainebott.fr or by phone at +33(0)6 12 73 27 51.
Deadlines:
The company SAS BOTT undertakes to do everything possible to deliver the ordered products as quickly as possible. Deadlines vary depending on the product, the chosen delivery method and the destination country of the goods. If in the order, the products have different delivery times, it is the longest delivery time that applies to the entire order.
Stock and out of stock:
In case of out of stock on a ordered product, SAS BOTT undertakes to inform you as soon as possible and will offer you different alternatives:
-Replacement of the out of stock product with the next vintage or with an equivalent or superior quality product under the same pricing conditions.
-Refund of the unavailable product(s) or of the entire order according to the customer’s choice.
In case of temporary out of stock, the customer will be offered the choice to wait until the restocking date which will be indicated to him. The customer will have the possibility to accept and wait to receive his entire order, request partial or full cancellation of his order.
Right of withdrawal:
CONDITIONS
You have the right to withdraw from this contract without giving any reason within fourteen days (14 days).
The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the goods.
To exercise this right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
EFFECTS OF WITHDRAWAL
In case of withdrawal from your part of this contract, we will refund all payments received from you minus €3.00 including VAT per bottle corresponding to delivery costs within 30 days from the day we are informed of your decision to withdraw from this contract.
We will proceed with the refund upon receipt of the return of the wine(s) by check or by bank transfer.
You must return the goods to us without undue delay and in any event no later than 15 days from the day you informed us of your decision to withdraw from this contract.
You will have to bear the direct costs of returning the goods.
Your liability is only engaged with regard to the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the goods. In the event that certain products have been opened or consumed, SAS BOTT reserves the right to deduct these products from the refund made to the buyer.
For any withdrawal, the wines must be kept in the best conditions so that the quality of the wines is not altered. They must be stored at an average temperature of 11 to 16°C. Upon receipt of the return, an analysis of the bottles will automatically be carried out by SAS BOTT’s services to verify that these storage conditions have been respected. For example, if the bottles have been stored in a space exposing them to a temperature above 18°C or below 6°C, SAS BOTT can easily check this with the state of the bottle corks, in which case no refund will be possible.
Protection of minors:
The provisions of the Public Health Code concerning the sale of alcohol to minors have been amended by article 93 of the HPST law.
The sale of alcohol is prohibited to persons under 18 years of age.
Upon registration, the customer acknowledges his majority.
Data protection:
We consider data protection to be a major issue in the trust relationship we have with our customers.
We make it a point of honor to respect your privacy and that is why the collection and processing of your personal data are respectful of legal provisions and regulations in force.
DATA COLLECTION
When you browse, create an account, purchase a product on domainebott.fr or when you contact our customer service, the company SAS BOTT, registered with the Saint Etienne RCS under number 803 590 405 collects certain data in order to meet your needs and provide you with optimal use. The information we collect is as follows: title, last name, first name, email, password, postal address, order information, information about your browsing on the site.
